Privacy Policy

This page describes the methods of managing the site with reference to the processing of personal data of users who consult it.
OMC Machinery Srl, Via Primo Maggio, 38, 24060 Bolgare BG, Italy (hereinafter referred to as the “Controller”), as the data controller, informs you, pursuant to EU Regulation No. 2016/679 (hereinafter abbreviated as “GDPR”), that your data will be used in the following ways and for the following purposes:
A. Subject of the Processing
The Controller processes personal identification data (such as name, surname, telephone number, email address – hereinafter referred to as “personal data” or simply “data”) provided by you.
B. Purpose of the Processing
Your personal data will be used:
- Without your express consent, as indicated by Article 6 lett. b), e) GDPR, for the following Service Purposes:
- To conclude contracts for the Controller’s services;
- To fulfill pre-contractual, contractual, and tax obligations arising from relationships with you;
- To comply with the obligations provided by law, regulation, community legislation, or an order from the Authority (such as anti-money laundering);
- To exercise the rights of the Controller, for example, the right to defense in court;
- Only with your specific and distinct consent (Art. 7 GDPR), for the following Marketing Purposes:
- To send you via email, mail, and/or SMS and/or telephone contacts, newsletters, commercial communications, and/or advertising material on products or services offered by the Controller and to measure the level of satisfaction with the quality of services;
- To send you via email, mail, and/or SMS and/or telephone contacts, commercial and/or promotional communications from third parties.
C. Methods of Processing
The processing of your personal data is carried out through the operations indicated in Article 4 No. 2) GDPR, namely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, limitation, communication, cancellation, and destruction of data. Your personal data will be processed both in paper form and electronically and/or automated.
The Controller will process the personal data for the time necessary to fulfill the above purposes and in any case for no more than 10 years from the termination of the relationship for the Service Purposes and for no more than 2 years from the collection of the data for the Marketing Purposes.
D. Access to Data
Your data may be accessible, for the purposes referred to in point C., to employees and collaborators of the Controller, in their capacity as authorized persons and/or internal data processors and/or system administrators.
E. Communication of Data
No data derived from the web service (therefore the above-mentioned navigation data and cookies) is communicated or disseminated (except for communication to judicial or police authorities if necessary).
Without the need for express consent, see Article 6 lett. b) and c) GDPR, the Controller may communicate your data for the purposes referred to in point B.1 to Supervisory Bodies, Judicial Authorities, insurance companies for the provision of insurance services, as well as to all subjects to whom the communication is mandatory by law for the fulfillment of the aforementioned purposes. These subjects will process the data in their capacity as independent data controllers.
F. Data Transfer
Personal data is stored on servers located in Bergamo, within the European Union.
G. Nature of the Provision of Data and Consequences of Refusal to Respond
The provision of data for the purposes referred to in point B.1 is mandatory. In their absence, we will not be able to guarantee you the Services of point B.1.
The provision of data for the purposes referred to in point B.2 (marketing purposes) is instead optional. You can therefore decide not to provide any data or to deny, at a later time, the possibility of processing data previously provided: in this case, you will not receive newsletters, commercial communications, and advertising materials related to the Services offered by the Controller. However, you will still be entitled to the Services referred to in point B.1.
H. Rights of the Data Subject
In your capacity as a data subject, you have the rights of access as per Articles 15 – 22 GDPR, namely the right of access, right to rectification, right to erasure (“right to be forgotten”), right to restriction of processing, right to data portability, right to object, as well as the right to lodge a complaint with the Supervisory Authority.

L. Filing a Complaint
The data subject has the right to lodge a complaint with the Supervisory Authority of the State of residence.
M. Automated Decision-Making Processes
The Controller does not carry out processing that consists of automated decision-making processes.
